Relationship Disclosures

Persons or entities that do business with LSU (hereinafter “a Supplier” or “Suppliers”) are expected to carry out their business with the University with diligence and professionalism and to comply with the highest standards of honesty, integrity, and fairness.

The supplier shall disclose to the University:

  • (i) any direct or indirect personal interests in a Supplier held by any trustee, officer, or employee of the University; and
  • (ii) any family relationship between a trustee, officer, or employee of the University and any director, officer, or employee of Supplier.

Louisiana Code of Governmental Ethics

Pursuant to the Louisiana Code of Governmental Ethics (R.S. 42:1101), Procurement is responsible for ensuring the following provisions are not violated:

  • Prohibited Contractual Arrangements (R.S. 42:1113): Prohibits public servants and their family members from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
  • Post Employment (R.S. 42:1121): Prohibits a former public employee from providing services on a contractual basis to their former state agency for a period of two years following termination of their public employment. This includes legal entities in which the former public servant is an officer, director, trustee, partner or employee.

Note: Other provisions may evaluated depending on the individual, agency, goods/services provided, resources utilized or source of funds.

Section 1102(13) of the Code defines “immediate family,” as it relates to a public servant as follows:

  • children
  • spouses of children (daughters-in-law and sons-in-law)
  • brothers and sisters
  • spouses of brothers and sisters (brothers-in-law and sisters-in-law)
  • parents
  • spouses
  • parents of spouses (mother-in-law and father-in-law)

In the supplier application, the supplier must disclose any potential relationship conflicts and provide justification identifying the employee and their relationship to the individual as well as to LSU. Additional information may be requested prior to approval of the supplier application or issuance of a purchase order or contract to ensure state statue is not being violated.

 

Active Employees

Active employees should not enroll as a supplier to provide goods or services to LSU. However, R.S. 42:1123(10), provides an exception to the general rule prohibiting public employees from participating in certain transactions involving their public employer. Section 1123(10)(b) exempts the following transaction:   

“A contract between an institution of higher education and a member of its faculty, research staff, or athletic coaching staff or a legal entity in which such employee has a substantial economic interest, regarding the disposition of any patent, copyright, licensing right, or royalty which is attached to a discovery, technique, or technology resulting from research done by such employee in the course of his employment with the institution, or regarding an activity related to or resulting from the athletic coaching or research activity of such employee conducted in the course of his employment with the institution.”

PM-67 is LSU’s compliance response to the procedural requirements of Section 1123(10). Active Employees must provide an approved PM-67 to proceed with supplier application approval.

 

Former Employees

Former employees are generally prohibited  from providing goods or services to LSU for a period of two years after their last date of employment at LSU. An individual's return to LSU within this period is subject to varying factors such as previous role and agency as well as proposed department/agency services will be provided. Former Employees must be prepared to provide this information to determine if eligible to become a supplier.

 

Teachers’ Retirement System of Louisiana (TRSL)

LSU Procurement helps to identify potential ineligible active employees currently contributing to and former employees who have retired and/or currently receiving monthly retirement benefits from Teachers’ Retirement System of Louisiana (TRSL). Pursuant to LSU HRM Guidance, individuals interested in employment through a contract, must be reviewed by LSU HRM/Benefits to determine eligibility for hire through a university contract.
